Abstract

The Toba Batak indigenous people are a kinship system that adheres to a patrilineal system that draws lineage from the male / father side. A child means a lot to his presence in a family. In the Toba Batak community, if a family does not have children, they can adopt a child who is called a naniain child. In the Batak community, sons are entitled to inheritance. This causes the status of men to be more recognized than women. Furthermore, for the successor of his father's clan. The problem in this study is related to the implementation of adoption to continue the offspring of the Batak Toba community in the Kelayang district and the position of the adopted children in the Batak Toba community to the inheritance of the adoptive parents in the Kelayang district. This type of research the author belongs to the Observational Research or survey research. Which is the author directly to the research location to obtain data collection tools in the form of interviews. While the nature of the author's research is descriptive, which means that this research can provide a clear and detailed description of the implementation of adoption to continue the descendants of the Batak Toba community in Kelayang District, Indragiri Hulu Regency. The results showed that the implementation of adoption in the Batak Toba community in the Kelayang sub-district who did not have children was carried out according to the Toba Batak custom which was carried out using the dalih na tolu which was attended by the family and invited all the Batak communities in the Kelayang sub-district. For Toba Batak indigenous people, especially parents, regarding the position of the inheritance rights of adopted and biological children, the distribution of inheritance will be equal.
