Abstract

Cageculture business is one of the business of people at Merangin Village Kuok district Kampar Regency which has the potential to improve the economy of local community where in the implementation of this business there is a cooperation between the cage owner and the employee, the cage owner prepare all the needs and the employee roles to cares and feeds the fish every day till the harvest day. Th formulation of the problem in this research was : What is the agreement system used in this business and how is the implemetation of profits sharing in this business cageculture at Merangin village is seen from Fiqh muammalah. The purpose of this reseach were: first, to know the agreement system that used in cageculture business at Merangin village. Second, to know the profits sharing of cageculture business at Merangin village. This is field research. In order to get the data, it used primary and secondary data. Then continue to collect data by using observation, interview and documentation. After data was collected, then analyzed by using descriptive qualitative method. The result of this reseach indicates the implemetation of profits sharing system of cageculture at Merangin village is one of Syirkah Mudharabah cooperation when if look at from the legal aspects of Syirkah Mudharabah namely the pillar of Syirkah Mudharabah, the conditions, principles, agreements and profits sharing (profits and looses). Then, the distribution of profits sharing of the cage owner and employee were 60% for the owner and 40% for the employee, because the employee did not provide the capital and only cares and feeds the fish till the harvest time, where according to the implemetation of agreement and profits sharing that can be seen from Fiqh Muamalah is called Syirkah Mudharabah. The suggestion in this research, in making agreement, it is better to have in written form in order to cause unwanted risks.
