Abstract

Mangongkos (tenancy) was an accepted transaction in Islam. The transaction object in tenancy referred to the benefit from the things for lease. One of transactions surfaced at Pastap Village Tambangan Subdistrict Mandailing Natal District was paddy farming tenancy. With the implementation for the agreement, it should be reviewed from Islamic economic perspective. Started from agreement process, subject, object and tenancy system, because it seldom happened deception and made one of parties made al loss. It was shown by Gharar and did not have transparency payment for the land. In this practice, it should be reviewed continuously. The purpose in this research examined: 1) knowing tenancy practice about paddy farming at Pastap Village Tambangan Subdistrict Mandailing Natal District North Sumatra Province. 2) described and analyzed the Islamic economic perspective from tenancy practice that happened in this village. This research used qualitative with conducted observation and interview to the villagers in order to get the data needed. Then, the data analyzed to reach a conclusion. Based on research findings, it could be concluded that this agreement about the tenancy for paddy farming in this village classified into invalid based on Islamic economic perspective. It was caused by gharar element or obscurity about the ending of tenancy, also the agreement based on the custom from immemorial time. From this research findings, this research could be as a correction reference to villagers at Pastap Village to do transaction in line with Islamic law. So that it could create safety condition, prosperous and appropriate with Islamic regulation.
