Abstract

The Covid-19 pandemic has had a significant impact, especially on the economic and social welfare sectors, worsening the conditions of low-income households and increasing the number of street children in Indonesia. This article uses a normative method with a statute approach, exploring the legal basis and relevant norms related to the protection of street children and criminal acts of trafficking. The focus is on street children who are victims of trafficking, who are the subject of criminological studies. The welfare state view and the principles of children's human rights are the basis for emphasizing the state's obligations in dealing with this problem. Criminological analysis highlights the criminogenic factors that drive children to engage in crime and provides the basis for holistic protection strategies. The government is mandated by law to ensure the fulfillment of children's rights and the implementation of Restorative Justice. Handling children in conflict with the law requires a humane approach and recognition of differences with adults. By involving the economic, health, education and legal sectors, this article proposes joint efforts to create an environment that supports street children, prevents exploitation and ensures the fulfillment of their rights.
