Abstract

Legal protection for workers is very important, especially when facing risks that may occur that are not in accordance with applicable laws and regulations. In Law Number 13 of 2003 concerning Manpower there is a solution regarding the rights and obligations of workers/laborers and employers in protection. There is protection discussed in Law No. 13 of 2013 concerning employment which contains protection for persons with disabilities, protection for minors, protection for women workers, working hours, safety, wages and welfare. Very important law no. 13 of 2003 aims to guarantee the basic rights of workers without discrimination. This study has two formulations of the problem, namely how to implement legal protection for security workers who work at night at SMPN 11 Pekanbaru and how to guarantee the rights and obligations of workers at night at SMPN 11 Pekanbaru. The research method used in this research is observational research, by means of a survey, namely research by going directly to the field using interviews. In terms of the nature of this research, it is descriptive because this research intends to provide a clear and detailed description of the problems that are the subject of the researcher. The results of the research carried out are legal protection for workers who work at night when viewed from Law Number 13 of 2003 including protection of working hours, wages and holidays and leave. Furthermore, the survey and interview results provide the fact that the right to protection for workers (security) who works at night has not been fulfilled.
