Abstract

This study examines legal protection in the sale and purchase of Nike branded shoes that have hidden defects found in the Andrea outlet shoe store in Pekanbaru, Riau. Law Number 8 of 1999 concerning Consumer Protection Article 8 paragraph 2 states that business actors are prohibited from trading damaged, defective or used and polluted goods without providing complete and correct information on the goods in question, however, branded shoe business actors at the Andrea Outlet shoe shop, Pekanbaru does not have a sense of responsibility for compensation for hidden defects that should be the right of consumers. The main problems raised by the researchers in this study are, first, how is the form of consumer protection against buying and selling Nike branded shoes that have hidden defects at the Andrea Outlet shoe store in Pekanbaru based on Law No. 8 of 1999 on consumer protection. Second, how are the obstacles in obtaining consumer protection against the sale and purchase of Nike branded shoes that have hidden defects at the Andrea Outlet shoes store in Pekanbaru. In this study, the researcher used a type of observational research method by conducting interviews with the Andrea Outlet Pekanbaru shoe shop businessman who had hidden defects. The result of this study is that the shoe business actor is not responsible for compensation for hidden defects that should be the rights of consumers. Consumer legal protection against buying and selling transactions of Nike branded shoes that have hidden defects has been regulated in the Act so that consumers have their rights fulfilled and get fair treatment as regulated in the Act, consumers have the right to submit complaints and get compensation due to hidden defects in the shoes he bought. Meanwhile, the obstacle to getting consumer protection is that consumers lack understanding and lack of knowledge about the laws and regulations related to consumer protection, while business actors argue that goods purchased cannot be returned with a note that has been stated in the note for buying shoes, which is very contrary to Law No. 8/1999 on consumer protection.
