Abstract

Law enforcement has not been running maximally because even though there have been actions to expel and forcibly reduce but violations of air space still occur, this is because Law No. 1 of 2009 concerning Aviation has not provided sanctions for penalties regarding criminal acts related to state sovereignty , what is regulated is only limited to the prohibited area and rectricted area. This means that violations are only interpreted as violating licensing into airspace alone (administrative violations), not violations of state sovereignty. The main problem of the research is how law enforcement against violations of airspace and space according to Law Number 1 of 2009, and how law enforcement against airspace violations by foreign aircraft entering the territory of the Republic of Indonesia in the area of Roemin Nurjadin Pekanbaru. The method of this research is observational research that is by way of a survey or reviewing directly to the location of the study using a data collection tool, namely interviews. While the nature is descriptive, that is describing and writing the facts examined in the field. The results showed that Law Enforcement Against Violations of Airspace and Space According to Law Number 1 of 2009 is subject to criminal and administrative sanctions if entering the prohibited airspace, it is punished with a maximum imprisonment of 8 (eight) years and a maximum fine of Rp. 500,000,000.00 (five hundred million rupiahs) and if entering the airspace is limited to a sentence of a maximum of 3 (three) years imprisonment or a maximum fine of Rp. 500,000,000.00 (five hundred million rupiah), Law Enforcement Against Violations of Airspace by Foreign Aircraft Entering the NKRI Area At Roemin Nurjadin Pekanbaru Airport is to make a forced landing as on the Ethiopian Airlines airline which is due to illegally entering Indonesian air sovereignty without equipped with Flight Clearance (FC).
