Abstract

The sale and purchase agreement is deemed to have occurred after reaching an agreement regarding an item and its price, even though the goods have not been delivered and the price has not been paid. In buying and selling online or what is commonly called e-commerce, many use a cash on delivery (COD) transaction system to carry out their buying and selling. Legal protection in online buying and selling transactions is needed both for consumers and business actors. As recently, there is often bad faith behavior by consumers when ordering goods with the COD system where consumers place orders but cancel unilaterally without explanation, this is commonly referred to as default which of course results in losses for business actors. The The main problem in this research is how is the form of unilateral cancellation in buying and selling online payment systems on the spot according to Law No. 8 of 1999 concerning Consumer Protection and how is the legal protection for business actors due to unilateral cancellation by consumers in buying and selling online payment systems on the spot. The method in this research is sociological legal research, namely collecting data by means of a survey, in which the researcher directly conducts research at the location with the intent and purpose of finding facts, which then leads to the identification and resolution of problems. The nature of the research used is descriptive analytical research, namely explaining and describing the realities in the field very carefully regarding unilateral cancellations in online buying and selling. The results of the study show that unilateral cancellations made by consumers in Cash On Delivery transactions are acts of default. The form of default committed by consumers is not doing what they are capable of doing and carrying out what was promised, but not in accordance with what was promised. Basically, there is legal protection for business actors in buying and selling online with on-site payment systems. This legal protection can be seen in Article 6 of the Consumer Protection Act concerning the rights of business actors. However, this law has not specifically regulated so that it still leaves a number of problems, such as consumers who do not have good intentions in carrying out their obligations so that business actors do not get their rights.
