Abstract
Soil is one of the most important natural resources for human life. The question of land is always present and sometimes relevant, increasing population, development, and widespread use by different parties with different fixed assets. Currently, land disputes cannot be prevented, given the current high demand for land, and the limited number of land parcels. Out of court (PPS) dispute resolution options can only be made if the parties agree to settle through the Pumping Agency (PPS). Then, non-judicial dispute resolution (PPS) developed in certain cases, such as certain criminal cases and labor disputes or environmental disputes and land disputes, so that the non-judicial dispute resolution option only applies. only in civil cases. The main problems in this study are (1) How are alternative dispute resolution mediated land cases related to legal certainty at the Pekanbaru land office, (2) What are the obstacles encountered in alternative dispute resolution mediation in land cases associated with legal certainty. This research is classified as a survey research. While the nature of this research is descriptive. The object of research is Alternative Dispute Resolution by Mediation of Land Cases Linked to Legal Certainty (Case Study at the Pekanbaru Land Office). The results of this study indicate that in solving existing land problems, the Pekanbaru City Land Office has carried out settlement of these disputes in accordance with established procedures and in problem solving. The Pekanbaru City Land Office prioritizes the mediation process for settlement which is facilitated by mediators from officials from the Pekanbaru City National Land Agency. Obstacles faced by the Pekanbaru City Land Office in carrying out land dispute mediation include the following; (1) Absence of the disputing parties, (2) There is no good faith from each disputing party, (3) Differences in ability and education between the parties and (4) Rules that are considered to slow down the dispute resolution process, because the Land Office domain as a mediator can not be a breaker / adjudicator. The efforts made by the Pekanbaru City Land Office are as follows; (1) Providing counseling and conveying land information to the public through land seminars in Pekanbaru City and (2) Sending employees within the Pekanbaru City Land Office, especially those dealing with land issues to attend Civil Servant Investigators (PPNS) training.
