Abstract

The concentration of this research is to find out and study the process settlement of legal issues between PT. Mazuma Agro Indonesia with the Six-Village Cooperative in Hutaraja Tinggi District, Padang Lawas Regency in an agreement on a member primary cooperative credit pattern (KKPA) The research was carried out in Hutaraja Tinggi District, Padang Lawas Regency. In addition, the authors also conducted research using data collection techniques in the form of library research, field research by conducting direct interviews with sources and questionnaires from related agencies and with parties who can provide information related to this research. the data obtained are presented in a descriptive juridical manner. Based on the analysis, the authors conclude several things, including: The mechanism in the implementation of the Primary Member Cooperative Credit (KKPA) agreement between PT. Mazuma Agro Indonesia With Six Village Cooperatives In Hutaraja Tinnggi District, Padang Lawas Regency. Starting with the signing of the cooperation agreement letter regarding the agreement on the credit pattern of the member primary cooperatives (KKPA). Primary Member Cooperative Credit (KKPA) which is managed by a cooperative of six villages in the Huta Raja Tinggi sub-district, Padang Lawas Regency, has an impact that causes an obstacle in this agreement is the existence of a regulation that is violated by the cooperative members and the Company in the contents of the cooperation agreement between the cooperative and the company is said to be prohibited from selling and buying palm oil plantation land (KKPA). The mediation mechanism that does not rely on any laws or regulations, only fixes on the habits of the village community. Barriers to the mediation process due to the limited ability of the parties due to advanced age, inadequate education, the mediator must explain to the parties. There is no readiness of the parties, both from the company and the cooperative, in resolving disputes that occur between the parties. The magnitude of the emotions of the parties. However, because the main issue is the implementation of the agreement between PT Mazuma Agro Indonesia and the Six Village Cooperative, it must be returned to the regulations contained in the contents of the agreement. that is, completely handed over to the Company and Cooperative, the reluctance of the parties to legalize the mediation decision.
