Abstract

In Sungai Tonang Village, North Kampar District, the buyer in buying and selling palm oil is called Hendra. Hendra buys from the palms harvested by the farmers. The sellers are oil palm farmers. The term tauke comes from Chinese or Chinese. This sale and purchase transaction of palm oil in Sungai Tonang Village, North Kampar District, occurred in a traditional buying and selling transaction, namely oil palm farmers and sellers directly face to face to make transactions. In Sungai Tonang Village, North Kampar District, the community makes an unwritten palm oil sale and purchase agreement, although it is not uncommon for defaults or broken promises by one of the parties to make the agreement. If the agreement is made in writing, if there is a default, it can be sued to the District Court with evidence from the plaintiff's letter, then the agreement has legal force. The main problem in this research is how to implement a palm oil sale and purchase agreement between oil palm farmers and the buyer's agent in Sungai Tonang Village, North Kampar District, Kampar Regency? and What are the legal remedies that can be taken by the parties in the palm oil sale and purchase agreement in the event of a default in Sungai Tonang Village, North Kampar District, Kampar Regency?. The research method used is empirical legal research by means of a survey, meaning that a research conducted by the author directly goes down to the field to obtain the necessary data by using a data collection tool in the form of interviews and the nature of this research is descriptive, namely describing as it is, in detail and clearly about implementation of oil palm sale and purchase agreements between oil palm farmers and buying agents in Sungai Tonang Village, North Kampar District, Kampar Regency. The results of the study indicate that the implementation of the palm oil sale and purchase agreement between oil palm farmers and the buyer's agent (Hendra) in Sungai Tonang Village, North Kampar District, Kampar Regency is carried out verbally/unwritten where the first party is the oil palm farmers who are partly incapable of the law and the buyer's agent (Hendra ) as the second party in implementing the palm oil sales agreement, there has been a default by the farmers and there is no legal action taken by the parties in the palm oil sale and purchase agreement between the oil palm farmer and the agent (Hendra) in Sungai Tonang Village, North Kampar District, Kampar Regency in the event of a default. However, the farmers will be penalized by the agent (Hendra) in the form of a 10% price reduction as the responsibility of the farmers who renege on the agreed agreement.
