Abstract

The writing of this thesis is the background of the many failed divorce mediation processes at the Pekanbaru Religious Court. So that the issues raised are: (1) How is the implementation of mediation with the involvement of experts, community leaders, religious leaders, traditional leaders, in divorce mediation based on Supreme Court Regulation No.1 of 2016 at the Pekanbaru Religious Court. (2) What are the obstacles for the mediator in mediating a divorce case at the Pekanbaru Religious Court. From this problem, the author's research aims to: (1) find out whether the mediator at the Pekanbaru Religious Court in conducting divorce mediation has ever involved or included figures as mentioned in the Supreme Court Regulation. (2) want to know what are the obstacles of the mediator during mediation so that many divorces cannot be reconciled. This research uses direct field research method, namely (observational research), and the data that the authors obtain is based on a field survey conducted by collecting information through interviews and questionnaires with respondents in the study and the nature of this research is (descriptive qualitative). ) namely describing or observing objects or subjects based on facts as they are. The conclusions of this study are (1) the mediator has never implemented or involved the figures mentioned in the Perma. (2) There are two obstacles, first from the internal factor, namely the lack of professionalism of the mediator in conducting mediation, and the parties have a strong desire to divorce so that it is very difficult to reconcile, and the second obstacle is the external factor, namely the influence of legal counsel and the influence of the family. the parties. Suggestions in this study (1) are expected to the mediator in conducting the mediation process for divorce cases to implement or enforce existing rules regarding the involvement of community leaders as regulated in the Supreme Court Regulation. (2) To the mediator whose job or role is as an intermediary party in solving problems, especially divorce cases, must prepare separate strategies and tactics in reconciling the parties wishing to divorce and also the mediator must be able to convince the parties that peace will get benefits and benefits between the parties so that their ties of friendship are still intertwined.
