Abstract

ABSTRACT Law enforcement carried out by law enforcement officers in the criminal justice system is one of the efforts that can protect the public from various forms of criminal acts that violate the provisions of the regulations that have been made. Related to law enforcement against perpetrators of clearing plantation land using the burning method which often occurs in Indonesia, especially in Riau Province, the police apparatus has a very important role in enforcing the law so as to create fair law enforcement. The research is a sociological juridical approach that is taken from primary data by conducting interviews and secondary data and reviewing directly to the field by processing data from primary legal materials, secondary legal materials and tertiary legal materials. The results of the study on Enforcement of Environmental Law in relation to Criminal Law are related to the legal substance in Article 69 paragraph (1) letter H of Law Number 32 of 2009 concerning Environmental Protection and Management concerning the prohibition of clearing land by burning and taking action against perpetrators to enforce Law and environmental law enforcement in Indonesia are affected by 3 (three) Aspects, namely Legal Products, Legal Systems and Political Risks that are always changing. The conclusion of law enforcement is that it is not justified to burn land for any reason, especially for plantation land, both as individual and corporate plantations. The legal basis for this prohibition is contained in the Criminal Code (KUHP) Article 187, Law number 41 of 1999. concerning Forestry, Law number 32 of 2009 concerning Environmental Protection and Management (UUPPLH), Law number 39 of 2014 concerning Plantations.
