Abstract

There are still companies that do not pay BPJS employment contributions for their workers, one of which is the case of not registering BPJS Employment at CV or PT legal entities in Pekanbaru City that meet the requirements for registering their workers, namely the salary of Rp. 1,000,000 (one million rupiah) for its workers and has more than 10 (ten) workers in a CV/PT. However, in reality the company/employer does not register workers on the grounds that the workers alreadyhave BPJS health which is registered by the workers themselves. In this thesis entitled "Legal Protection of Workers in Companies that Do not Pay BPJS Employment Contributions (Case Study in Pekanbaru City)" are discussed in the problem, namely: How is the Legal Protection of Workers in Companies that do not pay BPJS Employment contributions and What are the inhibiting factors and legal consequences for companies that do not pay BPJS contributions Employment. The method used to answer the problems mentioned above is to use the empirical legal research method (sociological) which is a data collection technique, where researchers conduct interviews and direct observations to the object of research to take a close look at the activities carried out. The results of the study indicate that the inhibiting factors found include: Factors from the government itself in which the Government as a labor inspection institution does not carry out its duties objectively in favor of or lacks control over various applicable laws and regulations, inhibiting factors from the aspect of facilities or facilities at In general, entrepreneurs are reluctant to establish harmonious industrial relations facilities within their companies, inhibiting factors inlaw enforcement from the community or environmental aspects can come from workers/laborers can also come from entrepreneurs, inhibiting factors from aspectsof workers/labor, inhibiting factors from the surrounding community, and the inhibiting factor from the legal aspect is that several existing industrial relations legal systems are not in accordance with the Pancasila industrial relations pattern. Sanctions obtained by the company from the violators are reprimand sanctions, administrative sanctions by paying fines to criminal sanctions. In this study, one company received a criminal sanction.
