Abstract

The position of the head of inheritance in the Minang Kabau community is very important because the head of the inheritance who is responsible for maintaining and developing the high inheritance owned by his people, in Minangkabau tradition a mamak must be able to carry out his role properly. The Minangkabau indigenous people draw a matrilineal lineage (mother line) as opposed to bilateral inheritance so that it can be seen that the inheritance law in the Minangkabau community (West Sumatra) is carried out collectively where the assets left by the heirs will be inherited together and cannot be shared except in its use. The main problem in this research is the role of Mamak Kepala Inheritance in resolving disputes over inheritance of high heirlooms of the banana tribe in Mandiangin Koto Selayang Subdistrict, Bukittinggi City and the constraints faced by Mamak Kepala Inheritance in solving problems that arise regarding the distribution of high heirs of the banana tribe in the District Mandiangin Koto Selayang, Bukittinggi City. This study aims to provide valuable input for various related parties, especially regarding the role of the head of inheritance and the settlement of disputes over the Timggi heritage property. The research method used in the observational research group was conducted by means of interviews. descriptive analytical, namely research that provides data as accurately as possible, and the object of study is about the role of the head of inheritance in the settlement of high inheritance inheritance disputes and the obstacles faced by the head of heirs in solving problems that arise in the distribution of high inheritance inheritance among the banana tribes in the District. Mandiangin Koto Selayang, Bukittinggi City. The role of the head of the heirs is very influential in maintaining the high inheritance of the people, which remembers the survival of his people, but there are also many mamak of the head of the heirs who are not indifferent to their roles and responsibilities in guarding the inheritance. Based on case No. 21/Pdt.G/2017 /PN.Bkt provisions on the peace deed ratified by the Bukittinggi District Court against inheritance disputes carried out by the parties Minangkabau customs should always preserve traditional culture and not easily trade. Especially for Mamak Chief Inheritance who migrated, in order to preserve and maintain prevailing customary values, and be responsible to their people. For Mamak Chief Inheritance Should use the Nagari Adat Density institution, which is a customary mediation institution that facilitates peace for parties in customary disputes , especially in the dispute regarding this High Heritage.
