Abstract
The study aims to provide legal protection to two parties (non-formal educational institution's owners and its teachers) in a non formal education institutional work agreement entitled to protection under the work agreement, both in the rights and obligations of the two parties and, the social security of the workforce in working relationship. This issue is a serious concern for both employees and employers. There are two problem statements in this study, which are (1) how does the protection of the two parties of work agreement in a non-formal educational institution under the Indonesian Labour Law-Act 13 of 2003-. (2) what is the legal action can be taken to anable the two parties of work agreement in a non-formal educational institution to obtain legal protection? As for the nature and type of this study is socialogical and empirical legal research in Tembilahan District. Data collection methods were obtained from direct research in the field quantitatively (questionnaire) and qualitatively (interview), and related literatures to the study's objective. The data analised by sentences description and interpretation of the data. The resultes of the study, first, the legal protection of the two parties of the work agreement in a non -formal educational institutions in Tembilahan has not received good legal protection yet. It is recommended that the two parties have to make written work agreement so that both parties have legal vorce in carrying out the working process in accordance with the Act 13 of 2003 and the Indonesian Civil code. Secondly, legal efforts that can be made in order to the two parties in non - formal educational institutions obtain legal protection by cultivating the awareness of the work agreement as stated in Act of the Labour agreement, including employment mechanism. As a result if in the future meet the default then they have permanen legal force.
