Abstract

This study is motivated by the lack of library research studies on Ba’i as-Salam contract according to Imam An-Nawawi. Imam An-Nawawi is one of the prominent figures of salaf scholar of Shafi'i cleric who devotes all of his thoughts to the progress of the Ummah. The formulation of the problem in this study is how Imam An-Nawawi’s thought on ba'i as-salam. The purpose of this study is to find out Imam An-Nawawi's thought on ba'i as-salam. The subject of this study is Imam An-Nawawi. While the object of this study is Imam AnNawawi's thought on ba'i as-salam in the works of Raudhatuth Thalibin. The type of this study is a library research. The approach used is through a philosophical approach. Research sources used are primary data and secondary data. The data collection technique used is documentation. The data analysis technique used is qualitative method with the process of editing, classification, coding, and interpretation. The interpretation is done by analyzing the concepts of ba'i as-salam according to Imam An-Nawawi which are analogous to the Compilation of Sharia Economic Law and DSN-MUI Fatwa. The results of this study are the concepts of ba'i as-salam according to Imam An-Nawawi if analogous to ba'i as-salam regulated by the Compilation of Sharia Economic Law and DSN-MUI Fatwa in terms of aspects: understanding, legal basis, contract, term and conditions, found that all of the elements are relevant or in accordance with the concepts of Imam An-Nawawi although there are slight differences of the statements but have the same meaning and purpose. The differences are only in terms of conditions that the muslam fiih (ordered goods) must be in the form of debt, it means that the goods ordered must be stated as a debt and not ba'i as-salam if the goods are available in place. This case does not exist in the Compilation of Sharia Economic Law.
