Abstract

ABSTRACT Correct transfer of land rights must be in accordance with the Regulations Government Number 24 of 1997 concerning Land Registration, with the form making land deeds made by PPAT will later be used as requirements for registering transfer of land rights to the land office Regency / City where the land is located. But seen in practice in our society today, we all know that it still is Many find the process of buying and selling land that is not carried out in accordance with the provisions of the applicable laws and regulations. As it is occurs in the sale and purchase of land which the author examined through a binding sale agreement buy land under this hand on a land object located in the Kelurahan Limbungan Baru, Rumbai Pesisir District. This land sale and purchase agreement only carried out by the heirs as sellers and buyers under the hands only on a stamp duty. Things like this must be socialized more so the public knows the cause and effect of the laws regarding sale and purchase of land rights. The research that the author examines determines the formulation of the problem, namely regarding the implementation of the agreement under the hands of buying and selling land in the Kelurahan Limbungan Baru, Rumbai Pesisir District and about the obstacles inside completion of land sale and purchase binding agreements in Limbungan Baru Village Rumbai Pesisir District. The method used in this study is seen from an angle the type is classified into the type of sociological legal research, namely by conduct observational research or surveys. Meanwhile, when viewed from an angle In nature, this research is classified as inductive research which means conclusions are drawn from the specific to the general, the specific these are the laws and regulations and these general matters is the result of research conducted by the author at the research location. From the results of the research conducted by the author, it can be argued that implementation of the sale and purchase of land is still widely found by selling buy land under hand, including one of the respondents from the case in research this. In terms of implementation, it is much easier than selling buy land in accordance with legal provisions. And other reasons were found from the results of the research under study is to avoid taxes arising from the sale and purchase of the land. So that the community uses underhand agreement only.
