Abstract

The interpretation of Pancasila still tends to be done in accordance with the wishes and politics of the rulers, which does not see the cause and effect of the interpretation which sometimes contradicts the essence of Pancasila itself. Pancasila which is considered holy and sacred which seems to exceed the holy book always occurs in Indonesia by making Pancasila as the Sole Principle. In interpreting Pancasila, the ruler seems to impose his will even though it contradicts the contents of the content in Pancasila. Soekarno's interpretation of Pancasila which promoted the politics of NASAKOM, Suharto who promoted the Kejawen understanding and then Gus Dur with his Liberation understanding were a form of incompatibility with the content contained in Pancasila. This research formulates a problem, namely How the Development of the Pancasila Interpretation from the Old Order Era to the Reform Era and Why the Interpretation of Pancasila Different from the Old Order Era to the Reformation Era. The purpose of this study was to determine the purpose of the authorities in interpreting Pancasila and why the interpretation of Pancasila can be different. Researchers conducted a study that entered into a normative study with descriptive analysis by analyzing data. Namely the author collects the data needed and describes the object under study through the data. The materials that the authors collect are: First, primary legal materials. Namely the material which is the main source of research. Second, secondary legal materials are legal materials that have the function of adding / strengthening functions for the explanation of primary legal materials. Third, non-Legal materials are materials that with certain considerations are indispensable in legal research, dictionaries, encyclopedias, and others. While data analysis uses qualitative methods, namely analysis by describing or describing, then comparing the data with laws and regulations or the opinion of legal experts. The conclusion method uses the inductive method in which the authors draw conclusions from general to specific. This interpretation of Pancasila is a form of authoritarian ruler in carrying out his government system. Pancasila, which was legalized on August 18, 1945, always changes its interpretation depending on who nurtures and maintains it, and it greatly affects how the system forms and the understanding of the rulers in shaping the state. In interpreting Pancasila, the authorities do not use the correct method, the authorities tend to interpret Pancasila for political purposes and only according to their understanding without looking at the methods of interpretation.
