Abstract

Procurement agreement is an agreement between two parties, where one party has the obligation to deliver/provide the goods needed for the other party and the latter party is obliged to pay an amount of money based on the agreed price. The main problem in this research is how to implement the goods/services procurement agreement in improving Jalan Simpang Lubuk Besar Jayaloka between he Public Works Department of Highways and PT. Alumagada Jaya Mandiri in Musi Rawas Regency, South Sumatra Province and what are the obstacles in the procurement agreement for goods/services in the improvement of the Simpang Lubuk Besar Jayaloka road between the Public Works Department of Highways and PT. Alumagada Jaya Mandiri in Musi Rawas Regency, South Sumatra Province. The research method used is Observational Research by means of a survey, namely interviews and questionnaires as a data collection tool. This research is descriptive analytical, which provides a clear and detailed description of an event that occurred. From the results of the study, it can be concluded that the implementation of the procurement agreement for goods/services in improving Jalan Simpang Lubuk Besar Jayaloka between the Public Works Department of Highways and PT. Alumagada Jaya Mandiri in Musi Rawas Regency, South Sumatra Province, which has not been mplemented properly according to the contents of the road construction work package. However, in addition to providing certainty, the law must also provide protection for the rights and obligations of the parties involved in the agreement that has been made. In accordance with the concept of legal protection theory which is an nseparable part of the theory of legal certainty, where the law does not only provide protection to the parties involved. This aims to protect the rights and obligations of shareholders and stakeholders. Meanwhile, the constraints in the agreement for the procurement of goods/services in improving Jalan Simpang Lubuk Besar Jayaloka in Musi Rawas Regency, South Sumatra Province, are not in accordance with the agreed time period because the Regency Government has not been able to pay for the work of the contractor contractor because the cash is empty and not in accordance with the contents. contract, PT. Alumagada Jaya Mandiri committed negligence and received a written warning from the Public Works Department of Bina Marga, Musi Rawas Regency 2 (two) times in a row with a period of 2x24 hours per warning. PT. Alumagada Jaya Mandiri does not make payments to vendors or workers who work under their supervision and experience work accidents.
