Abstract

This online goods delivery application service is a delivery service for goods from and to destinations in which there is an agreement between the service provider and the consumer. This online delivery application allows consumers to send goods to other places with the help of drivers. The number of phenomena that require consumer protection aspects in this online goods delivery service, which of course has social and economic impacts, leaves legal issues that must be our common concern because the goods sent are lost and even damaged, so accountability for business actors is needed. Based on the above background, the problem to be answered is the responsibility of business actors for the safety of delivery of consumer goods in the transportation of goods through Go-Send services in Pekanbaru City and legal settlement of failures in delivery of goods experienced by consumers through Go- Send services in Pekanbaru City. This type of research is observational research by means of a survey, namely research that takes data directly from the population/respondents by conducting interviews as a data collection tool, then processing the data collected so that conclusions are obtained using the inductive method. Meanwhile, if viewed from its nature, this research is descriptive, namely research that explains in the form of clear and detailed sentences. The responsibility of business actors for the security of delivery of consumer goods in the transportation of goods through the Go-Send Service in Pekanbaru City is the responsibility due to an error by taking into account the principle of corporate liability, namely that a corporation/company is considered responsible for mistakes made by subordinates/people within the company. the supervision in this case is Driver as a partner of PT. Go-Jek Indonesia which causes harm to others. Legal Settlement for Failure to Deliver Goods Experienced by Consumers Through Go- Send Services in Pekanbaru City that Consumers can take legal steps if the right to security of goods is not obtained, including the following: a. Submit a complaint to Tokopedia or Go-Jek to resolve the case, if there is no positive response, then the consumer can; b. File a lawsuit with the Consumer Dispute Settlement Agency; c) File a civil lawsuit to the District Court regarding Unlawful Acts, but so far, there have been no consumers who have taken legal action by filing a lawsuit to the Consumer Dispute Settlement Agency, or to the District Court.
