Abstract

Law Number 3 of 2006 concerning Amendment to Law Number 7 of 1989 concerning the Religious Courts affirms that the Religious Courts have the duty and authority to examine, adjudicate and resolve cases including sharia economics. The main problem in this research is how to resolve sharia economic disputes at the Pekanbaru Religious Court and what are the inhibiting and driving factors for sharia economic dispute resolution at the Pekanbaru Religious Court. This research is classified as aresearch survey. While the nature of this research is descriptive. The object of research is the settlement of sharia economic disputes in the Pekanbaru religious court, to obtain an overview of the implementation of the successes and obstacles faced in the litigation process. The results of this study indicate that the settlement of sharia economic cases at the Pekanbaru Religious Court is divided into two, namely simple event examinations and ordinary procedural examinations according to the Supreme Court Regulation Number 14 of 2016 concerning Procedures for Sharia Economic Dispute Resolution, the existence of a religious court in Pekanbaru City has been recognized by the community and district court in the jurisdiction of Pekanbaru City. And the obstacles in resolving sharia economic disputes at the Pekanbaru Religious Court are the inadequate human resources of the judges. And efforts that can be made to overcome the above obstacles are to increase the capacity and knowledge of judges as human resources to be prepared as members of the panel of judges in examining disputes over sharia economic activities, by holding trainings.
