Abstract
ABSTRACT the receipt is not in accordance with the reality that occurs in the field, the contents of the agreement say that if there is damage within two weeks of using the used car if there is damage it can be claimed to the car showroom, but after being claimed by consumers do not have the ethics of business actors to replace or claim damage to consumer cars, indeed not all consumers are not replaced but there are some consumers whose damage is not replaced by business actors reasons. The formulation of the problem is as follows, How is the implementation of the used car sale and purchase agreement in Pekanbaru, what and how to implement the used car sale and purchase agreement from beginning to end and the transaction process between business actors and consumers in carrying out this used car sale and purchase agreement. In the formulation of the problem, what are the obstacles in the implementation of the used car sale and purchase agreement in Pekanbaru, and what are the solutions that can be taken to resolve an obstacle experienced by business actors and consumers in the used car sale and purchase agreement in Pekanbaru. The method and type of research is empirical law with direct field observations in order to obtain definite data directly from business actors by using interviews or interviews aimed at educating consumers and the business actors themselves, with a sample of three used car business actors and fifteen related consumers, with research locations in three showrooms in the city of Pekanbaru that sell used cars. The results of this study indicate that the implementation of the sale and purchase agreement at the showroom in Pekanbaru is as follows, Filling out the form provided by the business actor to continue the sale and purchase transaction, Reading and understanding what the contents of the agreement have been given by the business actor to the consumer, After understanding everything the consumer has the right to see the condition of the existing car, the business actor explains what must be explained to the consumer so that negligence does not occur in the future. Once completed, the business actor will provide a damage claim if after 2 weeks of use there is damage to the car, and the business actor will process all claims submitted by consumers. The obstacle in implementing this agreement is the consumer's negligence in understanding the contents of the agreement that has been promised to the consumer, the lack of knowledge that makes the consumer lose and the lack of good ethics from business actors to claim the damage experienced by the consumer even though it has been discussed previously in the car sale and purchase transaction. used.
