Abstract
Hibah is one of the human ways to transfer property and rights to others, hibah must be implemented with authentic action when the property does not move like land but in Desa Kolam Kecamatan Percut Sei Tuan hibah on a piece of land is implemented under hand. The problem in this paper is what is the position of the land plot grant agreement and what causes the grant for a plot of land in Kolam Village, Percut Sei Tuan Subdistrict, North Sumatra. In this research, this type of research uses empirical juridical research methods with descriptive research characteristics. Data collection tools used were interviews and questionnaires. The data obtained were then analyzed descriptively qualitatively and then conclusions were drawn using the deductive conclusion method. The research results obtained that the position of the grant agreement over a plot of land in the pond village is legal in the eyes of the law, but the proof is less than perfect because it does not contain an authentic grant deed, the underhand agreement only has formal evidentiary power, if the signature and statement contained in the letter acknowledged and justified, the underhand letter actually already has the power of proof. The reason for the occurrence of underhand grants is because the surrounding community is not familiar with the management at the notary's office so that they think that underhand deeds have perfect legal force.
