Abstract

The narcotics problem in Indonesia is an urgent and widespread problem. Now it is not uncommon for children to abuse narcotics. As referred to in the law, the government and other state institutions are obliged and responsible for providing special protection to children, one of which is a child who is a victim of abuse of narcotics, alcohol, psychotropic substances and other addictive substances (drugs). According to the principle of the best interests of the child, child defendants (children who violate the law) are not sentenced to the death penalty, life imprisonment, and other crimes that are not in accordance with this principle. Due to this, the author is interested in conducting a thesis research entitled: Legal Protection of Children as Class One Narcotics Abusers for Yourself in the Pekanbaru Police Legal Area. The type of research that the author does is included in the type of empirical or sociological legal research, which functions to see the law in a real sense. Meanwhile, judging from the nature of the research, it is a descriptive analysis in the form of a description of the implementation of the case settlement mechanism. Normatively, legal protection for children as narcotics abusers has been regulated in laws and regulations. This protection includes monitoring, prevention, treatment and rehabilitation efforts carried out by the government and the community. In addition, in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, it is mandatory to make efforts that are converted into one of the legal protection efforts for children. However, there are obstacles such as negative labeling/stigma of children as narcotics abusers. In this case, socialization/legal counseling is carried out to educate the public regarding these problems.
