Abstract

Electric power is controlled by the State because it involves the livelihood of many people as regulated in Article 33 of the 1945 Constitution, considering that electricity is a community need. Therefore, the management and distribution of electricity is given by the State to the State-Owned Enterprises (BUMN), namely PT. PLN (Persero) as the holder of a Business License for the Provision of Electricity as stipulated in CHAPTER XVI Transitional Provisions of Article 56 of Law Number 30 of 2009 concerning Electricity. In the implementation of the distribution of electricity, the community can submit an offer/request to PT. PLN (Persero) to get the flow of electricity by following all the procedures for connecting a new flow of electric power, in which PT. PLN (Persero) will give its approval (as long as it fulfills the requirements) which is then made in an electric power sale and purchase agreement contained in the Electricity Sales and Purchase Agreement (SPJBTL) which regulates the rights and obligations which are the achievements of each party. . If one of the parties is unable to fulfill the contents of the Electricity Sale and Purchase Agreement, a default will occur. Therefore, what will be discussed in the subject matter of this research is how the power purchase agreement was born and the rights and obligations between the two parties arise and when the default occurs and if there is a default, how to resolve the dispute. From the results of research interviews, defaults committed by customers/consumers are the destruction of the kWh meter measuring device owned by PLN and other installations installed in the customer's building as well as delays in paying the Supplementary Bill (TS) fine. This research is suggested that the rights and obligations of customers are positioned in a balanced state such as compensation for compensation regarding the speed of service provided to consumers according to the contents of the Electricity Sales and Purchase Agreement, it is also recommended that PLN pay attention to consumers for household electricity usage customers who experience damage to the electricity supply. measuring and limiting devices, consumers should maintain and carry out maintenance on the installation and distribution of electricity belonging to PT. PLN (Persero). Consumers also have the right to sue if the electricity supply company is negligent in fulfilling its obligations or it is called default and to the government to pay more attention to the lawsuits filed by customers/consumers of PT. PLN (Persero) even though electric power has an impact on the public interest and development.
