Abstract

The crime of corruption is one type of crime that can touch various interests concerning human rights, ideology, the state, the economy, state finances, national morals, which is a heinous act that tends to be difficult to overcome. corruption, namely by creating Law No. 31 of 1999 and Law No. 21 of 2001 concerning the Eradication of the Crime of Corruption. The problem in this research is the evidence and judge's consideration in the corruption crime of Berto Riawan who is the head of the PT. Karya Tunggal Mulya Abadi branch (Case study decision number 05/Pid.sus/Tpk/2019/PN.Tpg) The type of research , which is used in this study is Normative Law, namely writing in the form of a study document by studying the case file. Evidence for the Corruption Crime Decision Case Number 05/Pid.Su/TPK/2019/PN.Tpg. has been proven in accordance with Article 2 Paragraph (1) in conjunction with Article 18 of Law Number 20 of 2001 concerning the Eradication of Corruption Crimes in conjunction with Article 55 Paragraph (1) to 1 of the Criminal Code. -witnesses, expert witnesses, documentary evidence, instructions and statements of the Defendant. The defendant is the head of the branch of PT. Karya Tunggal Mulya Abadi who has committed unlawful acts because of the Defendant. And in the consideration of the Judge the Defendant was sentenced to 6 (six) years in prison.
