Abstract

ABSTRAC Online gambling is categorized as a cyber crime because in committing the crime, online gambling uses computers and the internet as a medium to commit the crime of gambling. Currently the Pekanbaru Police have handled this online gambling case, however, even though some of them have been handled by Pekanbaru Police Investigators, we still encounter some people who play online gambling at internet cafes and in public places. Pekanbaru Police Criminal Investigation Unit investigators cannot do much if there is no report from the public on these online gambling cases. The author sets out the main problem, namely the efforts made by law enforcement officials in cracking down on online gambling crimes in the Riau Pekanbaru legal area and the inhibiting factors or obstacles faced in law enforcement of online gambling crimes in the Riau Pekanbaru legal area. In writing this thesis using the legal research method of observational research, namely research directly to the research location by using data collection tools in the form of interviews. Meanwhile, if viewed from its nature, this writing is descriptive analytical, which means the research is intended to provide a detailed, clear and systematic description. Efforts made by law enforcement officials in cracking down on online gambling crimes in the Pekanbaru Police Legal Area are that law enforcement against online gambling has been carried out by the Pekanbaru Police Criminal Investigation Unit and is still using the instrument of Article 303 of the Criminal Code rather than Article 27 paragraph (2) Jo. Article 45 of the ITE Law. The threat of imprisonment under Article 303 of the Criminal Code is 10 years, heavier than Article 27 (2) Jo. Article 45 of the ITE Law which is only 6 years old. Inhibiting Factors or Obstacles Faced in Law Enforcement of Online Gambling Crimes in the Pekanbaru Police Legal Area include: Criminal sanctions against online gambling based on Article 45 of the ITE Law are lower than the threat of criminal sanctions in Article 303 of the Criminal Code, Differences in detention time, Lack of understanding and mastery investigators in the field of information technology, are not balanced with the development of the ability of online gambling actors and the use of electronic evidence requires expert testimony, but the Pekanbaru Police SatReskrim does not have the budget to finance the expert's honorarium
