Abstract
Islam is a religion that regulates every area of human life, such as rules, worship, morals and muamalah. One form of muamalah that people often encounter and do every day is buying and selling. Buying and selling is known as Al-ba'I. Along with the development of increasingly modern times, various forms of buying and selling have emerged, ranging from buying and selling methods to goods or objects that are used as objects of buying and selling. One of them is buying and selling shares. Currently, stocks are no longer a place to invest fully, but stocks can also be traded like other buying and selling. Shares are traded in the capital market. Simply put, the capital market connects sellers and buyers. The capital market in this case is the Indonesia Stock Exchange (IDX). Shares are traded with an online mechanism called an online trading system, which is a stock trading system that follows the development of technology and information. However, in the practice of buying and selling shares or trading on the Indonesia Stock Exchange (IDX) there are indications of products and types of transactions which are transactions that are prohibited in Islam and contrary to sharia principles. The main problem in this study is how the system of implementing the sale and purchase of shares at the Pekanbaru branch of the Indonesian Stock Exchange (IDX) and how Islamic law reviews the stock sale and purchase agreement on the Pekanbaru branch of the Indonesian Stock Exchange (IDX). The research method used by the researcher is the normative-empirical method. As well as the nature of this research is analytical descriptive, while the data collection tool in this research is through interviews and documentation related to the implementation of the sale and purchase of shares of the Pekanbaru branch of the Indonesian Stock Exchange (IDX) in terms of Islamic Law. The results of this study indicate that the stock sale and purchase contract at the Pekanbaru branch of the Indonesian Stock Exchange (IDX) is considered valid and halal if it fulfills and implements the National Sharia Council Fatwa No.40/DSN-MUI/X/2003 concerning Capital Markets and General Guidelines for the Implementation of Sharia Principles. In the Capital Market sector and the provisions of the terms and pillars of buying and selling in general, including: In terms of the parties to the transaction, Sighat (pronunciation of consent and acceptance), the goods being traded and the exchange rate of goods.
