Abstract

The purpose of this research is to find out how the procedures for the distribution of inheritance are based on customary law that applies in Kanagarian Koto Nan Ampek and aim to find out how the community responds to the application of Koto Nan Ampek customary law regarding the distribution of inheritance. This research was conducted in Pangkalan Koto Baru District, Kanagarian Koto Nan Ampek with respondents namely ninik mamak, traditional leaders, traditional leaders, parents of children out of wedlock, and community representatives. Data originating in this study were generated through documentation techniques, interviews and questionnaires. Data analysis conducted by researchers in this study is based on data reduction, data presentation and conclusion drawing. Based on the results of the data analysis and discussion, it can be concluded that the procedure for the distribution of inheritance in the inheritance distribution system in Koto Nan Ampek according to its own customary law is by means if the child is a boy and the first child is entitled to all the inheritance of the heir and is entitled to receive the inheritance. titles of traditional leaders passed down from their parents. Meanwhile, if the daughter has the right to occupy the traditional house prepared by the heir when she gets married. Furthermore, if they come from children out of wedlock, they will be sanctioned in the form of rejection from the indigenous people there and are not entitled to receive inheritance from their own heirs. Customary Law Community While the research method of observational research is obtained by means of a survey, which means the author directly observes the research location with the aim of obtaining the data needed by using various tools to collect data in the form of interviews. The nature of this research is descriptive, which means that this research provides an understandable and detailed picture. Regarding the results of the discussion about solving this problem by means of discussions between the families concerned with the traditional leader Koto Nan Ampek. While the settlement method and the impact and sanctions from the distribution of the inheritance of children out of wedlock in Koto Nan Ampek, the settlement is carried out by means of deliberation between traditional elders and community groups by giving customary sanctions, namely expelling them from the village and giving punishments for not being able to attend events. in the prevailing custom in Koto Nan Ampek.
