Abstract

Marriage is a good opportunity for a man and a woman to live together to form a family. As for underage marriage, Where underage marriage is something that should not be done because the marriage law has set an age limit for a man and a woman marry. Then, how If underage marriages must still be carried out, namely by means of: marriage dispensation. Marriage dispensation is a permit or granting of rights for someone to get married even though they have not reached the minimum age limit marriage he will be equated with people who can marry. The author writes the purpose of his thesis entitled legal review on increasing applications for marriage dispensation in religious courts Bengkalis in 2020, which is to find out what the causal factors are an increase in applications for marriage dispensation in religious courts bengkalis in 2020 and what are the legal consequences for increase in applications for marriage dispensation. In the Annual Report Bengkalis Religious Court in 2019 to 2021 there is an increase in 2020 which is so drastic. This research is a field research with using qualitative research methods empirical juridical approach. type and The data source used is primary data in the form of an Annual Report Bengkalis Religious Court and secondary data in the form of books, scientific works, and others. The data collection tools used are interviews and documentation. The data analysis techniques used in this research are data analysis that does not use population and samples but only using data from the Bengkalis Religious Court Office, Dan conclusion method. The results of this study. First, the factors causing the occurrence of increasing applications for marriage dispensation at the Bengkalis Religious Court in 2020, namely, Pregnancy Factor, Law Change Factor Marriage, Parental Factors, and Economic Factors. Second, How Legal Consequences in increasing the application When viewed from the acceptance The dispensation is due to the law of underage marriage after committing Underage marriage exists, that is, the child is considered an adult and considered competent in carrying out legal actions or he is not under the forgiveness of his parents again.
