Abstract

The large number of state losses is a record for law enforcement officials to be able to return state losses, so that they can be used for the benefit of the development of the Indonesian state. One of the breakthroughs made to further increase state losses against corruption is the creation of an MOU between the Prosecutor's Office, the Police and the Minister of Home Affairs Number: 119-49 of 2018 which states that state losses can be made against criminal acts of corruption before the examination process is included in the investigation. investigation stage with a period of 60 days for state losses. From the above background, the authors formulate the main problems, among others: First, How is the implementation of state losses in corruption based on APIP-APH in the investigation process?. Second, what is the legal position of perpetrators of corruption who have returned state losses? Judging from the type, this research can be classified into normative legal research or library research methods, namely law which is carried out by reviewing and researching library materials in the form of primary legal materials and secondary legal materials. While the nature of this research is descriptive, that is, it provides a clear and detailed picture of the main problem of the research. After going through the process of collecting and processing data, then the data is analyzed based on qualitative methods, then concluded deductively, namely conclusions from special things. From the results of the study, it is possible to open a solution to state financial losses in criminal acts of corruption based on the APIP-APH MoU in the Riau Regional Police which has been carried out in accordance with the provisions stipulated under the APIP-APH MoU, namely if state losses are carried out before entering the investigation stage. The implementation of state losses carried out has been carried out to the maximum by the Riau Police, this can be seen from the increase in state losses from 2018 to 2019. The legal position of perpetrators of corruption crimes who have returned state losses is based on the APIP-APH MoU and Presidential Instruction No. 1 In 2016, if there is an indication of state financial loss committed by a state administration official, this will be followed up with state financial loss prior to examination with administrative efforts.
