Abstract

Gold is a natural resource that has strategic value in the development of the nation and state. The involvement of the state in the arrangement and development and management is very much needed. Because gold mining is a natural wealth controlled by the state, it is used for the welfare of the people as a whole. In reality, there is an increasing number of illegal gold mining (PETI) in Kuantan Singingi Regency. Law Number 4 of 2009 concerning Minerals and Coal clearly prohibits the activities of Unlicensed Gold Mining (PETI). The activities of the unlicensed miners have become the main/permanent work. In the case of being caught red-handed, only the workers will be charged without arresting the owners of capital or backers who are always free from the snares of the law. The complexity of the PETI problem is not without a solution. Law enforcement by the Kuantan Singingi Resort Police is very necessary in an effort to prevent environmental damage and provide a deterrent effect. Based on the above background, the problem that will be answered in this thesis research is about law enforcement against the crime of illegal gold mining in the jurisdiction of the Kuantan Singing Resort Police and obstacles in law enforcement against the crime of illegal gold mining in the jurisdiction of the Kuantan Singing Resort Police. This type of research is observational research by means of a survey, namely research that takes data directly from the population/respondents by using interviews as a data collection tool. Meanwhile, if viewed from its nature, this research is descriptive, namely research that explains in clear and detailed sentences about Law Enforcement of the Criminal Act of Unlicensed Gold Mining in the Legal Area of the Kuantan Singingi Resort Police. From the results of the study, it can be seen that Law Enforcement Against the Criminal Act of Unlicensed Gold Mining in the Legal Area of the Kuantan Singingi Police Resort is an act or effort of the state based on its apparatus which starts from investigation activities, investigations and the file is transferred to the prosecutor's office. In addition, the form of law enforcement carried out by the Kuantan Singing Police Precinct is a repressive measure, namely conducting raids, arrests, burning dompeng machines and taking preventive measures. Barriers to law enforcement against illegal gold mining in the Kuantan Singingi Police Legal Area include economic factors, lack of public awareness, number of personnel (human resources), facilities and infrastructure, and community legal culture.
