Abstract
Basically, what will always be an important point in law implementation efforts is related to law enforcement which is very important and the main focus is the role of the State itself which is obliged and must participate in the responsibility to combat and eradicate narcotics crime. The formulation of the problem in this research is how to prove article 127 paragraph (1) letter a of law no. 35 of 2009 concerning narcotics abuse for oneself (case study no. 193/pid.sus/2019/pnmdn) and How are the legal considerations of the panel of judges in deciding case no. 193/pid.sus/2019/pnmdn). The author uses a method to explain and answer all the main problems, or the method used is the type of normative legal research group. The object of the study is how to prove the law that is regulated and applied properly by understanding phenomena based on previously known information, knowledge, literature, and ideas. While the nature is descriptive analytical. Descriptive, namely by describing a complete and clear statement about how to prove article 127 paragraph (1) letter a of law no. 35 of 2009 concerning narcotics abuse for oneself (case study no. 193/pid.sus/2019/pnmdn). From the results of the research that the authors get Narkoba is an abbreviation of narcotics and drugs/dangerous substances. In addition to drugs, the Ministry of Health of the Republic of Indonesia introduced the term Napza which stands for Narcotics, Psychotropics and other Addictive Substances. Narcotics consist of 4 groups, namely Group I, Group II, Group III, and Group IV. Psychotropics consist of Groups III and IV, while psychotropics of groups I and II are included in Narcotics. The most abused drugs are narcotics, psychotropic substances, and other addictive substances that cause addiction or addiction and dependence. Factors causing drug abuse are Internal Factors (factors that come from within the individual such as personality, anxiety, and depression and lack of religiosity) and External Factors (factors that come from outside the individual or the environment such as the presence of substances, family conditions, weak laws and environmental influences ). Drug abuse occurs in almost all circles, including adolescents and children. Teenagers are the largest number who abuse drugs. Drugs that are often abused are Heroin, Marijuana, Morphine, Cocaine, and Ecstasy. The use of one or several types of drugs that are carried out regularly outside the purpose of treatment and research can cause physical, mental and social functioning disorders.
