Abstract
Dispute resolution can be carried out through a litigation process or a non-litigation process. In resolving disputes on the financing of the UGT MUB (Barokah Business Capital) Sidogiri Pekanbaru Branch, in general, non-litigation is used by way of deliberation and mediation. The formulation of the problem is how to implement and what are the obstacles to resolving nonlitigation disputes at the Baitul Maal Wa Tamwil UGT Sidogiri Pekanbaru branch in terms of the Law of the Republic of Indonesia Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution?. The purpose of the study was to find out the implementation and what are the obstacles in resolving non-litigation disputes at the Baitul Maal Wa Tamwil UGT Sidogiri Pekanbaru branch in terms of the Law of the Republic of Indonesia Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. This research method is normative-empirical legal research. The sampling technique used the census method and purposive sampling. Respondents in the study were administrators and customers of BMT UGT Sidogiri branch Pekanbaru and negotiators. The results showed that the implementation of non-litigation dispute resolution at the Baitul Maal Wa Tamwil UGT Sidogiri Pekanbaru branch was carried out outside the court by way of negotiation. Non-litigation dispute resolution is regulated in Article 1 paragraph (10) of the Law of the Republic of Indonesia Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. The obstacle in resolving non-litigation disputes at Baitul Maal Wa Tamwil UGT Sidogiri Pekanbaru branch is the lack of commitment from the parties in resolving a dispute peacefully (negotiation), then there are customers who show a desire to make peace even though it is not optimal. Lastly, there is the inability of the mediator to resolve a dispute
