Abstract

The background of the problem is that there are still companies in Pekanbaru City that unilaterally terminate their employees by not submitting a termination request with the industrial relations dispute settlement agency along with the reasons on which it is based, and after the dismissal has been carried out, it does not provide severance pay to employees which should be the employee's rights. The formulation of the problem is what are the factors causing the unilateral termination of employment for contract workers by PT Rayo Indo Persada Pekanbaru City in 2020. What are the legal remedies taken to unilaterally terminate employment against contract workers by PT Rayo Indo Persada Pekanbaru City in 2020. The research method used is a type of observational research, namely research that observes and describes things that occur, both social and natural phenomena, within a certain time span, and researchers cannot control these phenomena. In obtaining data, the authors used data collection methods in the form of interviews and direct spaciousness. The results showed that the unilateral layoffs of contract workers of PT Rayo Indo Persada Pekanbaru City in 2020 based on Law Number 13 of 2003 concerning Manpower that the implementation of layoffs had not been carried out properly where the company did not pay, gave their rights so that what the company did had violated the provisions of the Act. Law Number 13 of 2003 concerning Manpower. Legal efforts made in the unilateral layoff of contract workers by PT Rayo Indo Persada Pekanbaru City in 2020 that under certain circumstances, from a legal perspective, should be categorized as having terminated the employment relationship regulated by law. However, the company does not pay attention to the existing regulations, so that companies often ignore it. In turn, the company also has the heart not to give its rights as stated in Law Number 13 of 2003 concerning Manpower.
