Abstract

The aim of this study as Juridical Analysis of the Position of Local Regulations of Riau Province Based on Religion according to UU Nomor 23 Tahun 2014 concerning Regional Government Regulation. This research has limited discussion regarding the formation of zakat regulations by regional government regulation. The main problem in this study is to analyze the position of Regional Regulations of Riau Government based on Religion according to Law UU Nomor 23 Tahun 2014 concerning Regional Government Regulation and to analyze does the position of Regional Regulations of Riau Government have contradiction with UU Nomor 23 Tahun 2014. This research is a normative legal research with descriptive analysis. The object of this study is the Riau Province Regional Regulations based on religion according to UU Nomor 23 Tahun 2014 concerning to Regional Government. The data used are secondary data. The data were analyzed qualitative method. The position of Riau Province Regional Regulation UU Nomor 2 tahun 2009 is not included in the authority of the regional government because it is based on religion, while religion is included in the authority of the central government. The authority of the Central Government is an exception to the widest possible autonomy. And also this position has contra witha absolute authority. There is no regulation that delegates the authority to regulate zakat to the Regional Government. The position of the Riau Province Regional Regulation is contrary to UU Nomor 23 Tahun 2014 that concerning to Regional Government because when we viewed from the content of the material, the Riau Government regulation on zakat is not in the context of the implementation of regional autonomy and co-administration tasks. Because the substance regulated in this regulation is a religious matter, which religion is an absolute government authority of the Central Government.
