Abstract
Property is one of the basic human needs and the most important need is the need for clothing or clothing, food or food and shelter or housing. One of the problems in the property business is that the house purchased does not match the expectations given by the developer. Likewise, PT Sonnyka Graha Perkasatama which is located on Jalan Toman is one of the housing companies that prepares a binding sale and purchase agreement (PPJB) if a prospective buyer wants to buy a housing unit. In the practice of implementing the binding sale and purchase agreement before the PT Sonnyka Graha Perkasatama housing is completed, it is not uncommon for the agreed selling price to not be followed by good service to prospective buyers, for example building quality, pre-sales and after-sales services, developers late in completing or handing over the building, facilities are not in accordance with what was agreed in the agreement, and so on. The main problem of this research is how is consumer protection in the house sale and purchase contract at PT Sonnyka Graha Perkasatama? and What are the legal remedies taken by consumers in the implementation of the house sale and purchase contract at PT Sonnyka Graha Perkasatama? The research method used in this research is using empirical legal research, with data collection techniques, namely interviews and observations. Judging from the nature of this research, this research includes descriptive research, namely research that provides a detailed and clear description of the main research problems. The results of the discussion of this study are Consumer Protection in the House Sale and Purchase Contract at PT Sonnyka Graha Perkasatama That there has been a default in the binding agreement for the sale and purchase of land and buildings (Housing). the buyer/consumer, including the duration of the work, the agreed housing facilities, the cost of correspondence and regarding its protection have been regulated in the consumer protection law. And the efforts made by the buyer for the default action by the developer in the House Sale and Purchase Contract at PT Sonnyka Graha Perkasatama it can be seen that from the responsibility of the developer or developer in the binding agreement for the sale and purchase of the house between the developer, the buyer has submitted a complaint to the developer but there is just the form of reasons given by the developer to argue from mistakes.
