Abstract

The Tesso Nilo National Park (TNTN) Conservation Area is one of the remaining lowland forests as the lungs of the world's carbon contributors in reducing global warming for wildlife which has significance for people's lives. However, in law enforcement against forest encroachment in Conservation Areas, which is experiencing obstacles and obstacles in the effort of law enforcement carried out by Civil Servant Investigators (PPNS) or Police Investigators, law enforcement of forest encroachment criminal acts in Conservation Areas, because there is no support with related institutions, interventions by other parties, and the community is not aware of the boundaries of the Tesso Nilo National Park. Based on the background of the above problems, this research has a main problem. First, how is law enforcement against encroachment in the Tesso Nilo National Park Conservation Area. Second, what is the obstacle in law enforcement against encroachment in the Tesso Nilo National Park Conservation Area. This type of research is research by survey or observational research (observational research) that is descriptive analysis, only describing the situation that occurs against the problems raised. The source of data in this study is primary data as primary data obtained directly from the field related to the subject matter supported by secondary and tertiary data. Then the data were analyzed qualitatively by selecting the articles containing the legal rules governing the crime of forest encroachment. The results showed, First, law enforcement of forest encroachment in the Tesso Nilo National Park conservation area was not optimal and did not provide a deterrent effect on the perpetrators. Structural bureaucracy of the government and law enforcement has not shown synchronization related to area management and law enforcement that is trapped into a problem in the community, so that criminal sanctions are only against perpetrators who are caught red-handed and cannot reach the main / intellectual actors. Second, the factors that hinder law enforcement against forest encroachment in the Tesso Nilo National Park, namely: disharmony of forestry laws with other laws, weaknesses of forestry laws related to criminal and proof articles, structural bureaucracy in government agencies and law enforcement agencies, lack of facilities and infrastructure and Employee Investigators Civil State Office of the Tesso Nilo National Park, legal awareness and community participation is still low on forest sustainability and is involved in encroachment.
