Abstract

In protecting animal ecosystems that are protected from extinction, based on Law No. 5 of 1990 concerning Conservation of Biological Resources and their Ecosystems, particularly those contained in Article 21 paragraph (1) and paragraph (2) and Article 33 paragraph (3), which is contained sanction of imprisonment for a maximum of 5 years and a fine of approximately 100 million rupiah. The main problem in this study is the obstacles in the legal settlement of criminal cases against the killing of protected animals in the legal area of the Pelalawan District Court and efforts to settle criminal cases against the killing of animals protected under Law No. 5 of 1990 concerning Resource Conversion Biology and Ecosystems (Study in the Legal Area of the Pelalawan District Court). The research method used was Observational Research by means of surveys, namely interviews as a data collection tool. In this study the authors conducted research directly at the research location to obtain materials, data and information related to this research. The nature of the research, this research is analytical descriptive, which gives a clear and detailed description of an event. The obstacles in the legal settlement of criminal cases against the killing of protected animals in the Legal Area of the Pelalawan District Court are that it is not running as it should, and the process of resolving cases of killing of animals protected by the responsible parties namely the perpetrators who kill the protected animals can be done with formal steps from continuing criminal material crimes against protected animals, which can be interpreted if someone has committed an unlawful act, then that person must be prepared to take responsibility for all the actions that he has done which can then be transferred to the District Court
