Abstract

Basically the work agreement is divided into two forms of agreement, namely a specific time work agreement (STWA) and an unspecified time work agreement (UTWA), a certain time work agreement in its implementation using a contract, whereas in an indefinite time work agreement usually uses an unwritten work agreement or work agreements verbally and PT Lutvindo Wijaya Perkasa uses contract work agreements and some are verbally. The main problem in this study is how the implementation of certain employment relationships at PT Lutvindo Wijaya Perkasa and what are the obstacles in the implementation of certain time work agreements at PT Lutvindo Wijaya Perkasa according to Law No.13 of 2003 concerning Employment. This research is included in the type of research observational research by means of a survey, that is by means of the writer descending directly to the field at the location of the study, the nature of this study is descriptive because this writer explains the conclusions in a clear and detailed manner about the main problem under study. The data collection system is by questionnaire and interview, while the population used in this study consists of the operations manager and workers of PT Lutvindo Wijaya Perkasa. The results of this study indicate that work agreements made unwritten are not optimal, namely regarding the rights and obligations of employers and workers not fully implemented properly, workers 'rights that should be employers' obligations include, wages in accordance with MSE, the availability of health insurance BPJS that is in accordance with the provisions of the Law, guarantees of work safety, and there are still many obstacles in the work agreement that are made unwritten, such as the unclear rights and obligations of both parties who make work agreements both written and unwritten at PT Lutvindo Wijaya Perkasa.
