Abstract

Violence is a form of crime that often occurs in the community, both violence against people and goods that are not only done by a perpetrator but also carried out by some and not only in a closed place or away from the crowd but also in public places and many people- people who witnessed the act, so that the violence is chaos that disturbs public order. In Case Decision Number 747 / Pid.B.2018 / PN.Bls, Bangkalis District Court Judges who tried and decided the case sentenced the defendant to prison namely Jasuri alias Uri bin Judan for one (1) year, because the judge considered the defendant had found guilty of violating article 170 of the Criminal Code. The formulation of the problem in this study is how is the evidentiary process in criminal acts violating article 170 of the Criminal Code in decision number 747 / pid.B / 2018 / PN.Bls. and How is the legal consideration of the panel of judges in deciding case number 747 / pid.B / 2018 / PN.Bls. This type of research is a type of normative legal research which uses secondary legal materials namely Decision Number 747 / Pid.B / 2018 / PN.Bls. and classified in research that is descriptive by describing the main problem under study so that conclusions can be drawn after going through inductive analysis. The results of this study are, bengkalis district court judges in deciding cases under investigation have been mistaken because they have applied the law incorrectly, in which the application of article 170 of the Criminal Code against a single defendant and that article should be fulfilled if there are several defendants in the same trial process.
