Abstract

Settlement of land disputes by mediation should be able to resolve the problem of land disputes, but in reality what has happened mediation failed. Problems related to the resolution of land disputes at the Pekanbaru City Land Office are related to the implementation and inhibiting factors of land dispute resolution through mediation at the Pekanbaru City Land Office. This type of research is Observational Research by means of a survey in which the authors conduct research directly to the research location. While this type of research is descriptive by using qualitative methods to provide a clear phenomenon or explanation. The method used in data collection uses interviews with 4 respondents, namely the Head of the Disputes Section, the Mediator and the Disputing Parties. The results of the research related to the implementation of land dispute resolution through mediation at the Pekanbaru City Land Office is in which both parties agreed to carry out mediation, but in practice one of the parties was absent or did not want to cooperate with the mediation. The inhibiting factor in its implementation consists of those where the complained party is absent due to invitations sent by the Land Office, which are incorrectly addressed or do not reach the complainant. Then, when the 3rd invitation the Land Office submits the invitation directly to the complainant to be present at the agreed mediation hearing, when the invitation has been accepted, the complainant chooses not to continue the mediation session and chooses to use the land dispute settlement that he faced through court.
