Abstract

Confiscation carried out by the Prosecutor's Office regarding the object of fiduciary security belonging to PT. BCA Finance Pekanbaru Branch as the Opposition Party against Mitsubhi Pajero Sport four-wheeled vehicles is against the law. That is because Suripto as the Most Distant Party II has not completed the overall fulfillment of its obligations on credit payments as a debtor every month to the PT. BCA Finance Pekanbaru Branch, but due to Suripto the Most Opponent II was caught in a Narcotics crime case, a fiduciary object in the form of a four-wheeled vehicle of the Mitsubhi Pajero Sport Brand, was forced to be confiscated by the Prosecutor's Office and it should have been taken into consideration by the Prosecutor's Office against the object or goods which were confiscated, do not let any other party be harmed by the confiscation as experienced by PT. BCA Finance Pekanbaru Branch as the Opponent in this case. In the research that the author did, set the issue of Third Party Resistance Against Expropriation of Financing Objects as Evidence in One of the Narcotics Criminal Cases in Case Number 258 / Pdt.G / 2017 / PN.Pbr as well as the Legal Considerations of the Judges Council on Third Party Resistance Against Confiscation of Financing Objects as Evidence in One Narcotics Criminal Case in Case Number 258 / Pdt.G / 2017 / PN.Pbr This writing when viewed from the type of research classified as normative legal research is research to examine and explore and find answers about what is every problem that should be examined consists of 3 (three) primary, secondary and tertiary legal materials. While the nature of this research is descriptive which means this study provides a clear and detailed description of the usurping of financing objects as evidence in one of the narcotics criminal cases in case number 258 / Pdt.G / 2017 / PN.Pbr. Resistance of a third party against the confiscation of the object of financing as evidence in one of the narcotics criminal cases in case Number 258 / Pdt.G / 2017 / PN.Pbr is a resistance carried out by a third party, because the contrarian does not agree with the confiscation carried out by the party The Prosecutor's Office that has seized Mitsubishi, the All New Pajero Sport Dakar 4X2 A / T Type in 2016, white, BM 500 SK Police Number, 4N15UBC7166 Engine Number and MMBGUKR10GH039834 Frame Number.
