Abstract

The implementation of law in people's lives is very important because the purpose of law is to create justice, legal certainty, and provide benefits to the community. The law must be implemented or obeyed by all people must be equal and equal before the law (Equality Before The Law). A criminal act is an act that violates a criminal code, threatened with punishment by law. But in this case not only adults can commit crimes but also can be done by minors, and the delinquency of children every year is always increasing. If we look closely at the development of criminal acts carried out by children so far, both from the quality and the modus operandi that is carried out, sometimes the violations committed by children are felt to have upset all parties, especially parents.The phenomenon of increasing criminal behavior committed by children, as if not directly proportional to the age of the offender. The main problem in this study is how the application of the law against the perpetrators of theft in the Tanjung Balai Karimun police and factors that influence the application of the law against the perpetrators of theft in the Tanjung Balai Karimun police. This study uses observational research or sociology through direct surveys to the field and sticking to the norms, rules, and provisions that apply and relating to this research to conduct scientific research on law. And conduct studies from various sources of law such as legal principles, expert opinions, and library materials, which are concerned with the problems in this study. In applying sanctions against children who have committed theft, the settlement must be prioritized by means of diversion as it should be as stipulated in law number 11 of 2012 concerning the juvenile justice system, it aims to avoid the stagmatization experienced by children, bearing in mind the nature and psychology children in certain cases require special treatment, as well as special protection, especially in actions that can harm the child's mental and physical development. Special treatment starts at the time of the investigation phase, must be distinguished examination of the case children with adults
