Abstract
The appointment of a notary is essentially a mutual agreement between the debtor and creditor. However, in practice, it is difficult for consumers to be able to appoint a notary other than those stipulated by the bank. It is possible that the notary who has been appointed by the bank tends to side with the bank more than the consumer, while the cost for the KPR contract is borne by the consumer. The realization of KPR credit and notaries that made PPAT at Bank Riau Kepri Panam Branch in 2013-2018 there were 263 units of KPR credit contracts handled by only 8 people. among others, Circular Number 023 / SE / 2018 concerning Guidelines and Cooperation Mechanisms with Notaries / PPAT, Public Appraisal Service Offices and Public Accounting Firms, which are a follow-up to the Financial Services Authority (OJK) regulation of the Financial Services Authority Regulation Number 13 /POJK.03/2017 concerning Use of Public Accountant Services and Public Accounting Firms in Financial Services Activities. In this study, there are the main problems. First: How is the partnership between the Notary / PPAT and Bank Riau Kepri Panam Branch in issuing housing ownership credit agreements? Second, what are the obstacles encountered in implementing the partnership. This type of research is observational research by means of a survey in which the authors conduct research directly to the research location. While the nature of this research is descriptive, because the author intends to provide a clear and detailed description of the problems that are the subject of research. The collected legal materials are analyzed by steps including descriptions, while systematization steps are used to describe the content and structure or hierarchical relationships between legal rules. In this systematization activity, a correlation analysis is carried out between the related legal rules so that they can be understood properly. Then in the end the authors draw the conclusions of this study inductively. From the research results, it is found that, First. Partnership between Notary / PPAT and Bank Riau Kepri, Panam Branch in Issuance of Home Ownership Credit Agreement. Whereas the housing ownership credit agreement between the Riau Kepri Bank Panam Branch is a one-sided standard agreement, namely an agreement whose contents are determined by a party with a strong position in the agreement. the strong party here is the creditor who usually has a strong economic position compared to the debtor. Second, the obstaclesx encountered in implementing the partnership. namely: Communication Factors (Communication) Communication that occurs between the bank and customers in the implementation of the mortgage loan agreement has not been maximally established. Community Factors One of the results of the increasing transactions in owning a house by means of mortgages that buy houses in installments or credit according to the time and agreement and the client's capacity.
