Abstract

According to Article 68 of Law Number 13 Year 2003 concerning Manpower, it clearly states that employers are prohibited from employing children. However, in fact it is known that most of the warehousing companies in Pekanbaru City are not aware of this provision. As happened in the Platinum Warehouse in Pekanbaru City. The formulation of the problems in this research are: 1) How is the implementation of legal protection according to Law Number 13 of 2003 for underage daily transport workers at the Platinum Warehouse in Pekanbaru City? and 2) What are the obstacles in the implementation of legal protection according to Law No. 13 of 2003 on daily transport workers at the Platinum Warehouse in Pekanbaru City? The type and nature of this research is classified as sociological, it is research that formulates the essence of the analysis carried out and uses qualitative empirical analysis techniques, while its nature is descriptive. The research location is in the Platinum Warehouse of Pekanbaru City with a total sample of 36 people. The results of this study are that there are still many companies located in the Platinum Warehouse of Pekanbaru City that still employ underage daily transport workers. The conclusions obtained from the observations of researchers conclude that, the application of Law Number 13 of 2003 concerning Manpower, is still not being adhered to optimally. Some of the provisions that have not been properly adhered to are the company or warehouse manager not giving permission to the child worker without official permission from the parents or guardian of the child labor in accordance with Law Number 13 of 2003 concerning Manpower, namely the existence of a written permission and agreement. work between the employer and the child's parent or guardian. However, in practice these provisions are still ignored by companies and warehouse managers on the grounds that they pay less wages if they employ child workers.
