Abstract
Law No 12 of 2006 concerning citizenship of the Republic of Indonesia provides guarantees for the citizenship of children resulting from mixed marriages. Based on these provisions it is considered as the best way to solve vulnerable and sensitive problems, namely regarding the nationality of a person related to the status and legal status of children of mixed marriages between Indonesian Citizens and Foreign Citizens. The law applies the principles of universal citizenship, ius sanguinus, ius soli, and mixed principles. This means that the child can choose his own citizenship according to what is best for himself. The main research problem examined is how the position of children from the results of mixed marriages based on Law No 12 of 2006 concerning Citizenship of the Republic of Indonesia and How Legal Protection for children of mixed marriages (dual citizenship in the event of divorce between parents after the entry into force of Law No 12 of 206 concerning Citizenship of the Republic of Indonesia. This type of research used in this study is research using the method of observation research, namely by surveying or reviewing directly to the location of the study using data collection tools, namely interviews. While its nature, the writer tries to give a detailed descriptive in nature, the writer tries to give a detailed description of the implementation of the mixed marriage in terms of Law No 12 of 2006 concerning Citizenship. From the results of this study it can be seen that children resulting from mixed marriages have the right to determine or choose citizenship. Of the two couples who had mixed marriages between Indonesian women and Singaporean citizens, their son's citizenship was dual citizenship. And for legal protection, these children can get legal protection from the State of Indonesia and the State of Singapore. For children of women, Indonesian citizens and Singaporean Indian citizens, the children follow the father's citizenship, Singaporean citizen. Then the legal protection obtained by the child is only from Singapore.
