Abstract

Insurance is formed by entering into an agreement between the human being as the insured and the insurance company as the insurer. An agreement on insurance is an agreement where most of the clauses have been determined by the insurance company and the insured does not have the opportunity to request a change. One of the companies engaged in life insurance is PT Prudential. For the Pru link insurance product, the fact is that it does not run smoothly, there are several problems that occur between PT Prudential and the insured party. This problem occurs due to the insured's lack of understanding regarding the provisions of implementing standard clauses in the policy which are deemed to have harmed the insured and the lack of transparency regarding the investment funds managed by the company PT Prudential. The main problem in this research is how the implementation of standard clauses on investment insurance policies at PT Prudential Tanjungpinang, and what are the obstacles in implementing standard clauses on investment insurance policies for the insured at PT Prudential Tanjungpinang. The purpose of this study was to determine the implementation of the standard clause application in the investment insurance policy at PT Prudential Tanjungpinang and what are the obstacles in implementing the standard clause application. The method used in this research is empirical law (observational research), which is research carried out directly to the place of the research object, to obtain data relating to the application of standard clauses on life insurance policies against investment insurance at PT Prudential Tanjungpinang. The implementation of standard clauses on investment insurance policies at PT Prudential Tanjungpinang has not fully implemented the regulations of the Consumer Protection Act and the Financial Services Authority Regulation of the Financial Services Sector. The obstacles in implementing the standard clauses at PT Prudential are that the Prudential company does not explain in detail the standard clauses to the insured, and the Prudential company's obligations that have been stated in the standard clauses in the investment insurance policy are not implemented.
