Abstract

Traffic problems have always been the main focus, one of which is traffic accidents. Traffic accidents result in the death of people including heavy traffic accidents. Traffic accidents involving private vehicles and public vehicles are caused by drivers / human error, pedestrians, vehicle conditions, road facilities and infrastructure, law enforcement officers / law enforcement in road traffic and local natural / weather factors. Traffic accident factors that often occur due to Human Error (human factors). Motorized vehicles and drivers who due to their negligence have resulted in fatalities, have been written or listed in the provisions of "Article 310 of Law Number 22 Year 2009 concerning Road Traffic and Transportation. The main problem in the research of the Juridical Review of Traffic Accidents That Resulted in Death in The Pelalawan District Court and the Implementation of the Law by Judges decide on traffic accidents that resulted in the death of victims at the Pelalawan District Court in connection with Progressive Law. While viewed from its nature, this research is to describe a reality in a complete, detailed, and clear manner. Juridical Review of Traffic Accidents That Resulted in Death at the Pelalawan District Court. Whereas in the peace trial "do not drop the criminal case charges", this means that even though the driver of the vehicle as the crashing party has paid a sum of money or compensation by the impacting party to the victim as compensation for medical expenses at the hospital or providing compensation for victims who have died to the party. the victim / victim's family but this does not drop the charges in the criminal case, or in other words the legal process must continue. And the Legal Policy by Judges Decides Traffic Accidents That Resulted in Death Victims at the Pelalawan District Court relating to Progressive Law, namely Judges in deciding a case must have a sense of justice, which is reinforced based on Article 5 paragraph 1 of Law Number 48 Year 2009 concerning Judicial Power, which reads "judges and judges of the constitution are obliged to explore, follow, and understand the values of law and the sense of justice that live in society. The use of penal mediation means can be seen as a process towards a just system in society. So that in the future the results of the criminal justice system process will not only lead to retributive (retaliation) to the perpetrator, but also prioritize the return of losses to the victim, both material and immaterial losses.
